Relief to Velim church attack case accused

Colva, November 16, 2016: Accused in the Velim church police attack case will heave a sigh of relief as the judicial magistrate first class Ram Prabhudessai, on Nov 14, dropped the Sections attempt to murder (307 IPC) and voluntarily causing grievous hurt to deter public servant from his duty (333 IPC).

Prabhudessai also declined to commit the case to the sessions court for trial. Charges were filed against Velim parish priest Fr Roman Gonsalves and others.

The case in brief is that on February 25, 2012, the police allegedly entered the Fr Gonsalves’ residence at the Velim Church while he was in prayer.

On seeing the police at the church premise, people gathered at the church. Parishioners were further agitated on seeing central paramilitary force personnel in large numbers near the church.

This led to a confrontation between the police and the public with the latter demanding the reasons for trespassing on the church’s premises late in the night.

The mob allegedly turned violent and in the confusion members of the public as well as the police personnel suffered injuries.

The police filed a chargesheet against Fr Roman Gonsalves, Patrick D’Silva, Angelo Afonso, Darwin D’Silva, Agnelo Silva, Savio Silva, Nigel Caiero, Nelson Caeiro, Agnelo D’Souza, Marcus Barros, Adolf Fernandes, Tony Rebello, Mario Rebello, AlinRebello, Atorim Pereira, Anjelo Fernandes, Savio Pereira, Max Colaco, Adlete Mascarenhas, Angelo D’Silva and Louis Fernandes under various Sections 307, 143, 144, 147, 148, 186, 321, 324, 326, 333, 341, 342, 353 read with Section 149 of IPC.

Attempt by the prosecution to withdraw the case was struck down by the same court in September this year.

On November 14, passing his order, Prabhudessai dropped Sections 307 and 333 charges and declined to commit the case to the sessions court for trial. The court has slated the case for January 6, 2017 for argument before charge.
